1. Introduction

These Terms and Conditions (“Terms”) govern the use of the AviationWiki platform, including its website (aviationwiki.net) and mobile application (“AviationWiki,” “we,” “us,” or “our”, ”Platform”). By accessing or using AviationWiki, you (“user,” “you,” or “member”) agree to comply with these Terms. If you do not agree, you must discontinue using our services. AviationWiki reserves the right to modify or update these Terms at any time, and continued use of the platform constitutes acceptance of any changes.

By using AviationWiki, you confirm that you are at leats 16 years old or meet the minimum age required by the laws of your country to use online services. If you are under this age you must not use our services.

2. Services Provided

AviationWiki is an online community dedicated to aviation enthusiasts. It provides features such as discussions (SkyLine), real-time aviation-related chat, airport spotting information (AirSpot), article reading, content sharing, and interactive communication between users. Some features require users to be logged in, including commenting on articles, participating in discussions, and sending messages.

3. User Accounts and Registration

To access certain AviationWiki features, users must create an account by providing a valid email, password, country, and username. Additional profile details such as a biography and profile picture may be added later. Users must ensure the accuracy of their information and maintain the confidentiality of their login credentials. AviationWiki is not responsible for unauthorized access to accounts due to user negligence.

4. Copyright Holders

The copyrights, licensing authorization and related legal permissions on all images, content, and photographs shown on this website belong to original uploaders of the AviationWiki. It is presumed that the uploader holds all the rights of the photographs, images, and pictures that the user is uploading, and nothing is stolen, hacked or copied.  

5. User-Generated Content

Users may upload and share text, images, and other content on AviationWiki. By posting content, users grant AviationWiki a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, distribute, and display such content on any AviationWiki-related platform, including its website and social media, with credit given to the username or display name of the uploader. Users are solely responsible for their content and must ensure that they have the legal rights to share it. AviationWiki reserves the right to remove any content that violates these Terms or applicable laws.

You acknowledge, affirm and confirm that you are granting AviationWiki’s website a non exclusive, perpetual, royalty-free, worldwide license to share and use your pictures for promotions, advertisements, brand awareness, display, and use in whole or in part in any online social or any other medium without any limitation or restriction. 

You agree that you are not expected to be compensated for the use of your pictures, photos and images on AviationWiki. You hereby waive any and all claims against AviationWiki for any remuneration for any of your uploaded images, photos, and pictures regardless of how or whether such images, pictures, or photos are used.

 You acknowledge that the purpose of brand promotion, advertisement, and use of your pictures is sustainability, financial growth, and monetary wellbeing of AviationWiki. You also acknowledge that such content is not violating any privacy rights of any air space, property or premises.


6. Prohibited Conduct

Users agree not to:
Share illegal, harmful, defamatory, or abusive content.
Engage in harassment, threats, hate speech, or discrimination.
Upload copyrighted material without authorization.
Use automated tools to extract data from AviationWiki.
Attempt to interfere with the platform’s security or functionality.
Post misleading or false information.
AviationWiki reserves the right to take action against users who violate these Terms, including suspending or terminating accounts.

6. Push Notifications

AviationWiki may send push notifications to users regarding new articles, discussions, and direct messages. Users have full control over notification settings and may enable or disable them at any time. However, some service-related notifications, such as security alerts or policy updates, may be mandatory.

8. Account Termination and Deletion

Users may delete their accounts at any time. Users wishing to remove their content entirely must contact support@aviationwiki.net. AviationWiki may also terminate accounts for violations of these Terms or legal requirements.

9. Privacy and Data Collection

AviationWiki collects and processes user data as described in its Privacy Policy. The platform does not collect precise geolocation data but may store users’ country information to set default language preferences. AviationWiki takes reasonable measures to protect user data but cannot guarantee absolute security. By using AviationWiki, users consent to data collection practices as outlined in the Privacy Policy.

10. Content Accuracy Disclaimer

AviationWiki publishes aviation-related articles and allows users to share content. While we strive for accuracy, we do not guarantee the truthfulness, reliability, or completeness of any content posted by users or third-party sources. Users should independently verify information before relying on it. AviationWiki is not responsible for any decisions made based on content found on the platform.

11. Third-Party Integrations

AviationWiki may integrate third-party services for features such as translations, AirSpot, analytics, or external article links. We are not responsible for the privacy practices, terms, or content of third-party services. Users interact with third-party services at their own risk.

12. Platform Availability and Modifications

AviationWiki strives to maintain uninterrupted service but does not guarantee continuous availability. We may modify, suspend, or discontinue any feature at any time without prior notice. Users acknowledge that the platform may experience technical issues, updates, or maintenance that could affect availability.

13. Legal Jurisdiction and Governing Law

These Terms are governed by and construed in accordance with the laws of Portugal. Any disputes arising from these Terms or the use of AviationWiki shall be resolved in the courts of Portugal. Users agree to submit to the exclusive jurisdiction of these courts.

14. Entire Legal Document

The failure of us to exercise or enforce any right or provision of the terms of this Agreement shall not constitute a waiver of such right or provision.

15. Severability 

 In the event that any provision of any of the terms, rules and conditions of this Agreement are determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law and the unenforceable portion shall be deemed to be severed from this Agreement and such determination shall not affect the validity and enforceability of any other remaining provisions. 

16. Indemnify

To the extent permitted under applicable law, you hereby agree to hold harmless and indemnify AviationWiki in the event that any person, entity or a third party make claims against your uploaded pictures, photographs, and images.

18. Acceptance of Terms

By registering for an account or using AviationWiki, users confirm that they have read, understood, and agreed to these Terms and Conditions. If a user does not agree, they must discontinue using AviationWiki immediately.

You hereby agree to all terms, rules, and conditions of this Agreement and your use of AviationWiki’s platforms will signify your consent.
